Duo held
in 2-state kidnap
probe

AUGUSTA -- Two men on probation in Maine for aggravated assault have landed in hot water after being accused of kidnapping two Foxy Lady employees in New Bedford, Mass.
Roy C. Gutfinski Jr. aka TRASH, 26, of Augusta, and Jason L. Daprato, 36, of Manchester and Rockland, are being held without bail at Kennebec County jail, charged with violating probation by committing crimes in Massachusetts.

Both men were arraigned Wednesday via video in Augusta District Court and denied the charges listed by their probation officer.

Gutfinski was ordered held without bail, and his next court appearance in Maine is set for June 5.

District Attorney Evert Fowle said Daprato was removed from the hearing room at the jail Wednesday because of his behavior. Fowle said Daprato will be appear again on the probation revocation charges today.

Fowle said both Gutfinski and Daprato have long criminal records. He said Daprato could face two years behind bars and Gutfinski even longer.

"They should expect to do all the remaining time on these violations," Fowle said.

Gutfinski was convicted in 2000 of being an accomplice to an assault in Augusta in which a girl's back was sliced with a razor blade and her blood imbibed. Daprato was convicted of in 1999 of assaulting three teens in Gardiner with a baseball bat.

A document filed with the Kennebec County Superior Court by Gutfinski's probation officer charges that Gutfinski committed 12 violations of probation, three of those in New Bedford.

Roy Gutfinski and Daprato were arrested Sept. 5, 2006, after two women used a cell phone to call police from inside the bathroom of a New Bedford hotel room.

According to a New Bedford police report, the two women had gone to the room with the men after meeting them in the Foxy Lady club, but became nervous after the men shed clothing and used cocaine. The women said the men then refused to let them leave.

Daprato and Gutfinski were arrested and charged there with kidnapping and possession of cocaine and marijuana.

New Bedford District Court records show the kidnapping charges against both men were dismissed Jan. 23.

Pursuant to an investigation into the likelihood that Gutfinski and Daprato had violated their probation, authorities searched Gutfinski's residence in Oakland on April 19 and allegedly found cocaine, the steroid anabol, alcohol and dangerous weapons.

The charges also say Gutfinski left Maine without permission from his probation officer and failed to obtain approval to associate with a new girlfriend or with Daprato.

Daprato is also accused of possessing cocaine and trafficking in marijuana on April 18 in Manchester and leaving the state without permission.
